Paxton ran for the Texas House of Representatives in District 70 in the Republican primary in 2002. He received 39.45% of the vote and advanced to a runoff against Bill Vitz, whom he beat with 64% of the vote.

He went on to compete for the newly redistricted vacant seat against Fred Lusk (D) and Robert Worthington (L). Paxton won with 28,012 votes to Lusk’s 7,074 and Worthington’s 600 on November 4, 2002.
